Founded in 1981, Aprifel, the French Agency for Research and Information on Fruit and Vegetables, is a non-profit association governed by the French Act of 1901. Its aims are to use science for practical applications, to act as an interface between scientists, civil society and fruit and vegetable professionals, to help popularise and disseminate scientific data on fruit and vegetables and, finally, to collectively promote healthy, sustainable food. In keeping with its mission, Aprifel has a governance structure in which scientists, civil society and professionals are represented. Aprifel’s main policies are decided by its Board of Directors, and its actions are implemented by permanent teams guided by the Scientific Council and the Consumer Council.

1. DEFINITIONS

Capitalised terms used in these Terms of Service, whether plural or singular, shall, respectively, have the following meanings:

  • “Terms of Service”: means these general conditions for using the Aprifel Website and, more specifically, the features and services offered therein and any documents supplementing them.
  • “Media library”: refers to the provision by Aprifel of information media and reference documents for downloading by Users.
  • Documentation platform: on-line platform accessible at https://documentation.aprifel.com
  • “Privacy Policy”: means the policy, accessible from the Aprifel Website, specifying the terms and conditions for collecting and processing Users’ personal data and the use of cookies.

2. PRESENTATION OF THE APRIFEL WEBSITE AND ITS FEATURES AND SERVICES

2.1 Purpose of the Aprifel website and the features and services offered

The Aprifel website provides a space dedicated to the dissemination of scientific information on fruit and vegetables, particularly concerning their importance with respect to diet, sustainability, eating habits and food safety. In particular, it contains detailed nutritional fact sheets, popularised scientific journals, articles, dossiers and news dedicated to fruit and vegetables, which can be accessed by Users at the following address: www.aprifel.com.
Any use of said information and data shall be at the Users’ own risk.
Consequently, Aprifel cannot be held liable for the content or accuracy of all or part of the information communicated via the Website and for any order or investment decision based on such information.

Through its Website, Aprifel makes various features available to Users to enable them to benefit, in particular, from the following services:

(i) consulting and downloading journals on the role of fruit and vegetables in a healthy, sustainable diet and the tools facilitating access to them.
(ii) subscribing to Aprifel reviews and newsletters and to events organised by Aprifel.
(iii) The Website provides users with a knowledge base on fruit and vegetables and related scientific news.
(iv) Access to the documentation space, where health-education professionals and Aprifel partners can order and receive free information tools on fruit and vegetables.

2.2 How to access the Aprifel Website

Users are personally responsible for setting up the IT and telecommunications resources required to access the Aprifel Website and the features and services offered therein, and for acquiring the knowledge required to use the Internet. The Aprifel Website is compatible with the recent versions of the following browsers: Chrome, Safari, Edge, Firefox.

Users shall bear the connection and equipment costs associated with Internet access and use of the Aprifel Website and the features and services offered therein, which they use at their own risk.

Users undertake to use the Aprifel Website in a responsible and lawful manner, in particular by not accessing data that is not intended for them; and by communicating, where appropriate, lawful, sincere and authentic information via the Aprifel Website;

It is forbidden to attempt to obtain unauthorised access to the Aprifel Website or to the features and services offered therein, or to access or maintain access thereto by any means other than the interface provided by Aprifel to Users for this purpose.

2.2.1 Conditions for using documents accessible from the Aprifel Media library

Aprifel grants Users a personal, non-transferable, non-exclusive right to use, disseminate and exploit the information tools available in its Media library. This right of use, dissemination and exploitation is granted free of charge and on a revocable basis, subject to Users complying with the following terms and conditions:

  • the documents shall be used exclusively for information purposes (for example as part of an exchange between a healthcare professional and their patient, or in a teaching context), to the exclusion of any commercial or advertising purpose (i.e. use to promote commercial products or services without any informational and/or educational objective);
  • the documents shall not be used in a way likely to damage or denigrate the image of fruit and vegetables or Aprifel, or with the aim of calling into question the nutritional recommendations for regular daily consumption of fruit and vegetables;
  • the words “Source Aprifel” + link to www.aprifel.com, shall be placed in the immediate vicinity of the documents or in a contextual-credits directory for the work;
  • Users shall send proof of publication to Aprifel.
  • The right of use granted to Users may under no circumstances be interpreted as a transfer of intellectual property rights to the documents. Any use that does not comply with these terms of service or with the scope and terms of the operating licence granted by Aprifel to Users constitutes an infringement punishable under the Intellectual Property Code and exposes the User in question to civil and/or criminal proceedings.

3. WARRANTY

3.1 Aprifel warranty

Aprifel will do its utmost to ensure uninterrupted access to the Website in accordance with the state of the art, except in the event of interruptions required for maintenance, technical or legal constraints, or possible breakdowns, without Aprifel being held liable for such periods of interruption to the Website or Users being entitled to any compensation whatsoever.

Aprifel offers no other guarantees as to the operation of its Website and the features and services offered therein other than those described in these Terms of Service.

3.2 User obligations

Users shall comply with the terms and conditions of operation of the Aprifel Website as described in these Terms of Service. Users shall be capable of using the Aprifel Website and the features and services offered therein, and shall be of legal age.

Users shall not use the Aprifel Website and the features and services offered therein for fraudulent or illegal purposes or in a manner that contravenes public order or morality or that in any way prejudices Aprifel.

Users shall use the Aprifel Website and the features and services offered therein in a responsible and lawful manner and in particular shall refrain from:

(i) disrupting or interrupting the operation of the Aprifel website;
(ii) using data-mining systems, robots or any other similar automated method to collect and/or exploit data from the Aprifel Website;
(iii) aggregating, copying or duplicating the content of the Aprifel website;
(iv) impersonating another person, in particular another User;
(v) deleting or modifying (or attempting to do so) content published by another person, in particular another User.

The information contained on the Website is as accurate as possible and the Website is periodically updated, but may, nevertheless, contain inaccuracies, omissions or shortcomings. If Users notice a shortcoming, error or what appears to be a malfunction, they shall notify Aprifel by email, describing the problem as precisely as possible (page causing the problem, triggering action, type of computer and browser used, etc.).

Users shall be solely liable for their use of the Aprifel Website and for any harmful consequences attributable to a fault on their part, with respect to Aprifel or third parties.

4. LIMITATION OF APRIFEL’S LIABILITY

4.1 Limitation of liability regarding the purpose of the Aprifel Website

Aprifel may not be held liable for any damage whatsoever affecting Users due to any use of the Aprifel Website and any features and services offered therein that do not comply with these Terms of Service.
It is the Users’ responsibility to check the accuracy of the information published on the Website. Aprifel shall in no way be held liable for the way this information is used nor for any direct or indirect prejudice that may result. Users download its content at their own risk and under their sole responsibility. Consequently, Aprifel may not be held liable, for example, for any damage suffered by a User’s terminal (e.g. computer or smartphone), or for any loss of data resulting from downloading.

Photos are non-contractual.

Aprifel cannot be held liable for the hyperlinks on the Website to other resources on the Internet.

4.2 Limitation of liability regarding operation of the Aprifel Website

Aprifel undertakes to ensure that the Website, and the features and services offered therein, function properly.

However, Aprifel may not be held liable for any inconvenience or damage that Users may suffer as a result of using the Aprifel Website or inconvenience or damage linked to the use of the Internet network, in particular an interruption in service, external intrusion or the presence of computer viruses.

Aprifel is bound only by an obligation of means with respect to the features and services offered via its Website. Under no circumstances may Aprifel be held liable for unforeseeable, indirect or immaterial damage such as loss of profits, or loss or damage to brand or reputation.

Furthermore, Aprifel cannot be held liable for:

(i) a total or partial impossibility for Users to access the Website or to use the features and services offered therein due to an electronic communications operator or access provider.
(ii) a fault or negligence on the part of Users.
(iii) incompatibility of the hardware used or its configuration, with the Website and the features and services offered therein.
(iv) events caused by a third party or third-party software.
(v) a case of force majeure, including the interruption of telecommunications systems for any reason whatsoever.

5. PERSONAL DATA

Personal data transmitted by Users while browsing through the Website are processed by Aprifel in accordance with the Privacy and Cookies Policy brought to the attention of Users and accessible from the Aprifel Website.

6. INTELLECTUAL PROPERTY

Aprifel and/or its Partners are the exclusive owners of the intellectual property rights to the content of the Website as well as to the features and services offered therein and the Documentation accessible therein, including, but not limited to: trademarks, logos, domain names, graphic charters, texts, gifs, animations, sounds, icons, illustrations, photographs, leaflets, posters, images and videos, whether visual or audio, databases, as well as their formatting.

Any reproduction, representation, dissemination, distribution, translation, modification, adaptation, retransmission or publication, even partial, of these various elements is strictly prohibited without the express prior written consent of Aprifel. Any such representation or reproduction, by any means whatsoever, may constitute an infringement for which the person responsible may be held civilly and criminally liable. Aprifel reserves the right to take legal action against the person responsible for the infringement.

Certain visuals integrated into the Aprifel Website required use of external sources to which Aprifel has acquired the rights or which are open source.

The Aprifel Website and the services offered therein may contain hyperlinks to other websites published by third parties or other resources available on the Internet, over whose content Aprifel has no control.

Consequently, and insofar as the hyperlinks have been included on the Aprifel Website solely to facilitate User browsing, consultation of third-party sites is the User’s choice and their sole responsibility.

Aprifel cannot be held liable for any damage whatsoever resulting from the content of these external sites or sources, and in particular from the information, products or services they offer, or from any use that may be made of them. The risks associated with this use are fully incumbent on Users, who shall comply with their respective terms of service.

Nor can Aprifel be held liable for any damage or loss, whether actual or alleged, arising out of or in connection with the use of, or reliance on, the content, goods or services available on these external sources.

8. GENDER EQUALITY INDEX

Act No. 2018-771 of 5 September 2018 (known as the “Professional Future” Act), supplemented by Decree No. 2019-15 of 8 January 2019, requires employers to have a system for assessing pay gaps between women and men, leading to a public social rating of the company and, for those in which the gaps are excessive, the obligation to implement corrective measures (Articles L 1142-7 to 10 of the Labour Code).

For 2024, the Aprifel Interfel UES (Economic and Social Union) index was 79 points out of 100.

This index, ranging from 0 to 100 points, is constructed from the following indicators, the results of which are given here:

  • the gender pay gap: 29 points out of 40
  • the difference in the rates of individual salary increases and promotions: 35 points out of 35
  • salary trends for women returning from maternity leave: indicator not calculable
  • the number of women and men among the 10 highest earners: 10 points out of 10

The total number of calculable indicators is averaged to a scale of 100 points using the proportionality rule.

9. MISCELLANEOUS PROVISIONS

9.1 Duration – Enforceability

These Terms of Service remain binding on Users for as long as they remain Users of the Aprifel Website and/or the features and services offered therein.

9.2 Tolerance

The failure of either Party at any time to require strict performance by the other Party of any provision or condition of these Terms of Service or the Privacy and Cookies Policy shall not be deemed a waiver of such provision or condition.

9.3 Nullity of a clause

If any of the non-essential clauses of the Terms of Service or of the Privacy and Cookies Policy should prove to be null and void or inapplicable by virtue of an Act or regulation or following an enforceable decision by a competent court or authority, the Parties expressly agree that these Terms of Service shall not be affected by the nullity of the clause in question.

9.4 Language

These Terms of Service are a translation of the French CGUs: in the event of any dispute over meaning, the French version shall predominate.

9.6 Applicable law and dispute resolution

These Terms of Service are governed, interpreted according to and subject to French law. Any dispute relating to these Terms of Service or to the features and services offered therein, which cannot be resolved amicably between the User and Aprifel, will be subject to the exclusive jurisdiction of the courts having jurisdiction over Aprifel’s registered office.
